2. Text messaging terms
Program. By providing your mobile number and agreeing to receive text messages, you consent to receive SMS and MMS messages from Black Market Racing. Messages include appointment confirmations and reminders, vehicle status updates, repair approval requests, estimates, completion notices, and, if you opt in separately, promotions and shop news.
Consent is not a condition of purchase. You do not have to agree to receive text messages to get an estimate, book an appointment, or have work done on your vehicle.
Message frequency. Message frequency varies based on your vehicle and your service history.
Cost. Message and data rates may apply. Contact your mobile carrier for details about your plan.
Opt out. Reply STOP to any message to stop receiving texts. You will receive a single confirmation message and no further messages after that. Reply START to resume.
Help. Reply HELP to any message, or call us at (480) 382-1696.
Carriers. Mobile carriers are not liable for delayed or undelivered messages.
Privacy. Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties. See our Privacy Policy.
3. Estimates and authorization
We provide an estimate before we begin work. Estimates are based on the condition of the vehicle as we find it and on parts pricing at the time of the estimate.
We do not begin work until you authorize it. Authorization may be given in writing, electronically, or verbally, and we record it.
If the job changes, we stop and call you. If we discover additional work is needed, or the cost will exceed the authorized amount, we will contact you and get your approval for the revised amount before continuing. If we cannot reach you, work stops until we do.
Diagnostic work. Diagnosis is a separate, billable service. We charge a diagnostic fee, which we tell you before we begin, and it is payable whether or not you go on to authorize the repair. Diagnosis is a service in its own right, and an accurate answer is a result even when the answer is that the repair is not worth doing.
Estimates for performance and fabrication work are inherently less precise than estimates for standard repair, because these jobs uncover conditions that cannot be seen from the outside. We will tell you where an estimate carries that risk before you commit.
4. Completion times
Any completion date or turnaround time we give you is an estimate, not a guarantee. Parts availability, machine work, supplier delays, and conditions discovered during the job can move it. We will tell you when a date changes. We are not liable for losses caused by a delay, including rental car costs, lost wages, or missed events.
5. Parts
Parts we supply. We use new, remanufactured, used, or aftermarket parts depending on the job, availability, and what you approve. We will tell you which we are using. Parts carry whatever warranty the manufacturer offers, if any. We add nothing to it. See Section 7.
Used parts. If you approve a used part and it fails and has to be replaced again, the replacement part and the labor are your cost.
Parts you supply. You may supply your own parts. If you do:
- We do not warrant customer-supplied parts in any way.
- If a customer-supplied part fails, is incorrect, is defective, or does not fit, you are responsible for the labor to remove and replace it, including labor already performed.
- We may decline to install a customer-supplied part if we believe it is unsafe or unsuitable, and we will tell you why.
Special orders and deposits. Special-order parts and custom fabrication may require a deposit. Deposits on special-order parts are non-refundable once the part is ordered.
Replaced parts. We will return your replaced parts if you ask for them at the time you authorize the work. Parts returned to a supplier under a core charge or warranty claim cannot be returned to you.
6. Vehicle storage, pickup, and abandonment
Pickup. Your vehicle is ready for pickup when we notify you. Please collect it within 72 hours of that notice.
Storage fees. Vehicles left more than 72 hours after we notify you the work is complete may be charged daily storage at the rate posted at the shop.
Our lien. Under Arizona law, a repair shop holds a lien on a vehicle for the value of the labor, parts, materials, and storage furnished, and may keep possession of the vehicle until the bill is paid (A.R.S. § 33-1022). A vehicle left unclaimed may be sold to satisfy that lien after the notice and process the statute requires (A.R.S. § 33-1023).
Personal property. Remove your personal belongings before you leave the vehicle. We are not responsible for items left in or on a vehicle.
Risk while in our care. We maintain garage keeper’s coverage as required. Except as that coverage provides, vehicles are left at the owner’s risk.
Covered work area. Our shop is a covered work area with no walls. While your vehicle is on site, we are not responsible for sun, wind, bird droppings, or similar environmental exposure.
Test drives. Diagnosis and verification often require driving the vehicle on public roads. By authorizing work you authorize us to operate the vehicle for those purposes.
7. Warranty
Black Market Racing does not provide its own warranty on parts or labor. Any warranty coverage comes from the parts manufacturer, on the manufacturer’s terms, and runs between you and that manufacturer.
What that means in practice:
- We will tell you what warranty a part carries, if any, before you approve it.
- We will give you the documentation, part numbers, and receipts you need to make a claim, and we will help you file it.
- A manufacturer warranty typically covers the part and not the labor to remove and reinstall it. Unless the manufacturer reimburses that labor, it is billed to you at our standard rate.
- Customer-supplied parts carry no warranty from us at all, and the labor consequences in Section 5 apply.
- Labor we perform is not warranted.
- Performance aftermarket parts and their installation generally carry no warranty.
Before you have our work redone somewhere else, call us. We are not obligated to inspect or correct it, but we want the chance to look at it, and we would rather hear about a problem than read about one.
DISCLAIMER. ALL SERVICES AND PARTS ARE PROVIDED “AS IS.” EXCEPT FOR ANY WARRANTY OFFERED DIRECTLY BY A PARTS MANUFACTURER, BLACK MARKET RACING MAKES NO WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, AND SPECIFICALLY DISCLAIMS ANY IMPLIED WARRANTY OF MERCHANTABILITY AND ANY IMPLIED WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE. NO STATEMENT BY ANY EMPLOYEE, REPRESENTATIVE, OR ADVERTISEMENT CREATES A WARRANTY.
8. Performance modifications, tuning, and assumption of risk
This section applies to any performance upgrade, forced induction installation, engine build, calibration, tune, or custom fabrication.
Manufacturer warranty. Modifying a vehicle may void some or all of the manufacturer’s warranty, at the manufacturer’s discretion. That decision belongs to the manufacturer and is outside our control. We are not responsible for a warranty denial that results from work you authorized.
Increased output means increased stress. Added power places loads on the engine, drivetrain, cooling, braking, and chassis beyond what the manufacturer designed for. Components not part of our work can fail as a result. You accept that risk when you authorize performance work. We will tell you where we see a weak point, and we will tell you when we think the next step is a bad idea.
Tuning results. Power figures are specific to the vehicle, the fuel, the ambient conditions, and the dyno used. We do not guarantee a specific horsepower or torque number, and figures measured on our dyno may not match figures from a different dyno.
Your responsibility after the work. Modified vehicles require closer attention: fuel quality, maintenance intervals, monitoring, and honest use. Recommendations we give you at handoff are part of the work. If you ignore them and something fails, that is on the vehicle owner, and any manufacturer coverage on the parts involved is likely to be denied.
9. Emissions, street use, and competition parts
Read this section carefully. It affects what we can legally do to your vehicle.
We comply with federal and Arizona emissions law. Federal law prohibits removing, defeating, or rendering inoperative any emissions control device on a vehicle used on public roads, and prohibits manufacturing, selling, or installing a part whose principal effect is to defeat emissions controls. Arizona law defines tampering as removing, defeating, or altering an emissions control device installed at the time of manufacture, and vehicles registered in the Phoenix metropolitan area (Area A) are subject to periodic emissions inspection and tampering inspection under A.R.S. § 49-542.
What that means in practice. We will not remove, disable, or tune around emissions control equipment on a vehicle that is registered for or operated on public roads. If you ask us to, we will decline and explain why.
Competition parts and closed-course vehicles. Some parts we sell or install are labeled for competition or off-road use only and are not legal for use on public roads. If you purchase or authorize the installation of any such part, you represent that the vehicle is used exclusively in sanctioned competition or off-road, that it is not registered for road use or is exempt, and that you are solely responsible for compliance with all applicable federal, state, and local law. You agree to indemnify Black Market Racing against any fine, penalty, or claim arising from road use of a competition-only part.
Emissions inspection. Passing an emissions inspection is the vehicle owner’s responsibility. We do not guarantee that any vehicle will pass, including after work we perform, unless the work was specifically an emissions repair and we say so in writing.
10. Racing, track, and off-road use
Motorsport is dangerous. If you take a vehicle we worked on to a track, a drag strip, an autocross, an off-road course, or any competitive or high-speed event, you do so at your own risk. We are not responsible for injury, death, or damage to property or the vehicle arising from competition or high-speed operation. This applies whether or not the vehicle was prepared by us for that purpose.
We will not knowingly prepare a vehicle for illegal street racing.
11. Projects started elsewhere
We take on vehicles other shops started or could not finish. When we do:
- We inspect and estimate based on what we can see. Hidden conditions from prior work may not surface until the job is underway.
- We are not responsible for any prior work. Nothing another shop did carries any coverage from us, and per Section 7 neither does our own labor.
- If prior work has to be redone to complete the job correctly, we will tell you and give you an estimate before proceeding.
- We may decline a project if we do not believe it can be completed safely or economically.
12. Payment
Payment is due when you pick up the vehicle unless we agreed otherwise in writing. We accept the payment methods posted at the shop. We do not release a vehicle before payment clears.
Returned checks and chargebacks are subject to any fee permitted by Arizona law, plus our costs of collection. Past-due balances may accrue interest at the maximum rate permitted by law. If we have to pursue collection, you are responsible for reasonable costs and attorneys’ fees.
13. Products purchased online
Products sold through our online store are governed by the terms and the return, shipping, and refund policies posted on that store. Those terms control for product purchases. These Terms and Conditions control for service work performed at the shop.
14. Website use
The content on this site, including text, photographs of our builds, logos, and the BMR name and marks, belongs to Black Market Racing and may not be copied or reused without permission.
Information on this site is provided for general purposes. Service descriptions, capabilities, and pricing indications are not offers and may change. Nothing on this site creates a contract until we give you an estimate and you authorize the work.
We do not guarantee the site will be available without interruption or free of errors.
15. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY ARIZONA LAW, BLACK MARKET RACING IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST WAGES, LOSS OF USE, RENTAL COSTS, TOWING, OR DIMINUTION IN VALUE, ARISING FROM OR RELATED TO ANY SERVICE, PRODUCT, OR USE OF THIS WEBSITE.
OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE AMOUNT YOU PAID US FOR THE SPECIFIC SERVICE OR PRODUCT GIVING RISE TO THE CLAIM.
Nothing in these terms limits liability that cannot be limited under Arizona law.
16. Indemnification
You agree to indemnify and hold harmless Black Market Racing, its owners, and its employees from any claim, loss, or expense, including reasonable attorneys’ fees, arising from your use of a vehicle we worked on, your breach of these terms, your representations about competition or off-road use, or your violation of any law.
17. Governing law and disputes
These terms are governed by the laws of the State of Arizona, without regard to conflict of law principles. Any dispute shall be brought exclusively in the state or federal courts located in Maricopa County, Arizona, and you consent to that jurisdiction and venue.
Before filing anything, contact us. Most disputes are a conversation we have not had yet.
18. General
If any provision of these terms is held unenforceable, the rest remain in force. Our failure to enforce a provision is not a waiver of it. These terms, together with any estimate and authorization you sign, are the entire agreement between us regarding the work.
We may update these terms. The current version is always posted here with its effective date. Work authorized before a change is governed by the version in effect at the time.
